- No Refunds for Customer Error: We are not responsible for orders placed with incorrect delivery addresses, incorrect items selected by the customer, or orders refused upon delivery without valid cause.

- Loss of profits, revenue, or data;
- Loss of business opportunities;
- Personal injury or property damage;
- Unauthorized access to or alteration of your data or transmissions;

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF PEQUOD'S PIZZA PARTIES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU IN FULL. IN SUCH CASES, PEQUOD'S PIZZA'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
The limitations of liability set forth in this section are fundamental elements of the basis of the bargain between Pequod's Pizza and you. Pequod's Pizza would not be able to provide the Services without such limitations.
8. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza and its respective officers, directors, employees, agents, contractors, licensors, licensees, successors, and assigns (collectively, "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

13.1 Informal Resolution

We will make good-faith efforts to resolve your concern informally within thirty (30) days of receiving your notice.
13.2 Binding Arbitration
IF INFORMAL RESOLUTION IS UNSUCCESSFUL, YOU AND PEQUOD'S PIZZA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT THAT: (1) EITHER PARTY MAY BRING CLAIMS IN SMALL CLAIMS COURT IF THEY QUALIFY; AND (2) EITHER PARTY MAY SEEK EMERGENCY INJUNCTIVE RELIEF IN A COURT OF COMPETENT JURISDICTION TO PREVENT IRREPARABLE HARM PENDING ARBITRATION.
Arbitration shall be conducted by a recognized arbitration organization in accordance with its applicable rules and procedures. The arbitration shall take place in the United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND PEQUOD'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND PEQUOD'S PIZZA AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.
13.4 Jury Trial Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PEQUOD'S PIZZA EACH HEREBY IRREVOCABLY WAIVE ALL RIGHT TO A JURY TRIAL IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICES.
If the arbitration clause in this Section is found to be unenforceable, then the entirety of this Section 13 shall be null and void, and in such case, the parties agree to submit any disputes to the exclusive jurisdiction of the courts described in Section 12.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you use the Website or Services. Pequod's Pizza may, in its sole discretion and without prior notice, suspend or terminate your access to the Website and Services at any time for any reason, including but not limited to:
- Your violation of any provision of these Terms;
- Your engagement in fraudulent, abusive, or illegal conduct;
- Requests by law enforcement or government agencies;
- Extended periods of inactivity on your account;
